Terms of Service
These Terms of Service ("Terms") govern your use of the Kairoscope mobile application ("Kairoscope," the "App," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use Kairoscope. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms in your jurisdiction.
2. Your Account
If you create an account, you are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your permission.
You may delete your account at any time from within the App. Account deletion removes your authentication record and your synced data from our backend (see the Privacy Policy for details). Anonymized aggregates that you explicitly opted in to share may persist as part of community-level statistics.
3. Your Content
Kairoscope is a personal journaling tool. You retain all rights to the journal entries, notes, tags, and other content you create in the App ("Your Content"). We do not claim ownership of Your Content.
By choosing to enable cloud sync, you grant us a limited, non-exclusive license to store and transmit Your Content solely to provide the App's functionality (syncing your data across your own devices, generating Kairoscope narratives, and similar). We do not use Your Content to train machine-learning models, sell data to advertisers, or share it with third parties beyond what is described in the Privacy Policy.
When you opt in to share anonymized aggregates ("Share insights"), you grant us a license to use those aggregated, non-identifiable values to compute community statistics and to display comparison features in the App.
4. Acceptable Use
You agree not to:
- use the App to harass, threaten, or harm others;
- attempt to access another user's account or data;
- interfere with or disrupt the App's infrastructure (including the abuse-prevention controls described in the Privacy Policy);
- attempt to reverse-engineer, decompile, or extract the source code of the App except where applicable law allows;
- use the App to transmit unlawful content; or
- use the App in any way that would violate applicable laws or regulations.
5. AI-Generated Narratives
Kairoscope can generate "kairoscope" narratives — short reflective pieces produced by an AI model from anonymized aggregates of your data. These narratives are provided for personal reflection only. They are not professional advice (medical, psychological, legal, financial, or otherwise), and you should not rely on them as a substitute for qualified professional guidance. AI output may be incomplete, inaccurate, or unexpected; we do not guarantee any specific result.
6. Optional Tips
Kairoscope is free to download and use. Optional consumable in-app purchases are available: Buy me a coffee ($0.99), Support the mission ($4.99), and Champion ($9.99). Tips do not unlock features or entitlements. Purchases are processed by Apple or Google according to their store terms.
7. Service Availability
We strive to keep the App and its backend services available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Features that depend on third-party services (such as Firebase or AI providers) may also be affected by those providers' availability.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you.
10. Termination
You may stop using the App at any time and delete your account from within the App. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (including ownership of Your Content, disclaimers, limitations of liability, and dispute resolution) will survive.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, notify you in the App. Your continued use of the App after the new Terms take effect constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which the App's operator is established, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer-protection rights you have under the laws of your place of residence.
13. Apple App Store Notice
If you obtained the App from the Apple App Store, the following additional terms apply: these Terms are between you and us, not Apple, and Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. To the maximum extent permitted by applicable law, Apple has no warranty obligations with respect to the App.
